Can a landlord refuse to rent a unit to people with minor children because there are no recreational facilities for children in the complex?

No. A landlord cannot refuse to rent based on the lack of facilities.


Can housing complexes which are reserved for senior citizens or the elderly refuse to rent to people with minor children?

Yes. Specialized housing for senior citizens may exclude children.


Can a landlord require a higher security deposit from people with minor children than from people without children?

No. Security deposits are capped under Rhode Island law to no more than one month of rent.  While that is the maximum amount that can be charged, it is unlawful to set deposits based on the stereotype that children as a class cause more damage to property than others do.


Can a landlord impose a nighttime curfew to minor children?

No. Curfews may not be imposed on anyone in the complex.


Can a landlord ask on a rental application for the ages or birthdates of each person who will occupy the unit?

No. The landlord may, however, ask each person signing the rental agreement to certify that he or she is at least 18 years old (and therefore has legal capacity to enter into a contract or lease).
